GENERAL TERMS OF BUSINESS
The following terms and conditions apply for all contracts, deliveries and services that are performed in connection with an order made on the Schneggenstein website. Any customer terms of business that deviate from the following terms and conditions do not apply. Deviating terms and conditions shall only be a valid part of a contract if written permission has been granted by Schneggenstein.
DATA PROTECTION AND REGISTRATION
The protection of your personal privacy when using our website is of great concern to us.
This declaration delivers information pertaining to the data that is transmitted to us when visiting our website and what happens with this data. There is no exchange of data with any other companies, the data protection declaration is restricted to your visit to our website and does not refer to other websites.
Data collection and its application
You can principally use our website without having to declare any personal data. The only data that is collected during your visit is in connection with the statistical evaluation of our online presentation and automatically collects information on operating system, browser type, your IP address, referrer URL and date of visit to our website.
This data is only assessed for statistical purposes to further optimise our online presence and make our service more attractive. Data collection and temporary storage is performed in an anonymous fashion such that its use does not permit any inference as to your person. Personal data is only collected that is supplied by you in connection with an order or enquiry or through the sending of E-mails.
Any data collected shall only serve for the fulfillment of the purpose they were provided to us for and for which purpose you have permitted them to be used.
By using our website and registering, data is automatically stored in the logfiles that we receive from your browser (Internet Explorer, Firefox, Safari etc.) during your visit. Data protection – Data disclosure
Data received from you will only be disclosed to third parties with your explicit prior consent or if we are by law obliged to do so.
In the time period between an order and delivery of such order the customer is obliged to immediately provide details of any changes to the contact details originally given. In the event that this information is not given declarations shall then also count as delivered if they are sent to the last notified address. The constant technical development as well as possible changes to the legal framework may make it necessary to adapt our data protection declaration. Schneggenstein maintains the right to make changes to the data protection declaration if deemed necessary to do so.
Implementation of Google Analytics
This website uses Google Analytics, a web analysis service of Google Inc. („Google“). Google Analytics uses so called “Cookies”, text files that are saved to your computer and allow analysis of your use of the website. The information generated by the cookie are normally transmitted to a Google server in the USA and stored there.
The implementation of IP anonymity on this website means that your IP address shall be given prior abbreviation by Google and by the member states within the European Union or other treaty states of the agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and then receive abbreviation there. Google shall, by order of the operator of this website, use this information to evaluate your use of the website, create reports on website activity in order to provide further services to the website operator connected with the use of the internet and website. Further to this, you can prevent the collection of data created by the cookie as well as data pertaining to your use of the website (incl. The representation of products on the homepage does not constitute a legally binding offer. Basically, only products that are available for delivery can also be ordered. An order can only be generated by the creation of a demand. This obliges customers to provide their contact details. The order shall only become mandatory upon order confirmation on behalf of Schneggenstein. By sending an order / demand, the customer confirms that the provided contact details are correct and that they can be reached through the Email given.
Products are only available through advance payment. The customer will receive an invoice with banking and contact details. Goods will only be dispatched after payment has been received. Should it not be possible to carry out an order then Schneggenstein shall inform the customer of this without delay.
DELIVERIES AND SHIPPING COSTS
Deliveries shall only be carried out by personal recorded delivery to the recipient listed in the order. Goods in stock shall be dispatched latest five workdays after receipt of invoice payment. Should there be any delays to the delivery then Schneggenstein shall immediately inform the customer thereof and give details of the probable delivery date. Should delivery to the customer not be successful because the customer is not present at the given address then the costs of the delivery shall be paid by the customer.
Customers have the right to return goods up to 14 days after delivery in accordance with the stipulations of the Consumer Protection Law / FAGG (Fern- und Auswärtsgeschäfte- Gesetz FAGG /). Shipping costs of returns are to be paid by the customer. Returns must include the goods ordered, the original packaging, the certificate, as well as the invoice. Damaged goods or goods that have already been worn shall not be refunded. The customer is obliged to pack the goods in appropriate packaging and return to the address given. Schneggenstein always tries to keep delivery times to a minimum. Customers shall waiver compensation claims in cases of delivery delays.
PAYMENT AND PRICES
Payments must be made in advance. Payments must be made in the currency given in the invoice. All prices include the currently applicable Value Added Tax rates (sales tax) for the European Union. Shipping costs and any import charges shall be listed individually.
INSTRUCTIONS FOR USE AND WARRANTY
After successful delivery, a 2 year warranty period shall be provided by Schneggenstein on any previously existing damage. No warranty shall be provided in cases of improper use or damage from external causes.
Customers shall lodge complaints within 7 days after receiving goods in clear cases of material defect, manufacturing error or damage incurred through transport.
Images of jewelery pieces may differ in colour from reality due to the natural materials and graphic representation. Such deviations do not constitute a defect. Due to technical reasons the images are not depicted in the original size. Jewelery pieces with natural stones can vary due to the individual nuances, colouring and possible inclusions.
Leather is a natural material that shows signs of wear after being worn repeatedly. Schneggenstein offers customers a 20% discount when the old original leather strap is returned to us. A new leather strap shall be promptly sent to the customer after receipt of the old strap and the payment due.
Silver is a material that oxidises over time when exposed to air. Such jewelery pieces can show surface variations. Customers can send in their Schneggenstein jewelery pieces for cleaning. In such cases, the costs for cleaning shall be borne by Schneggenstein. Shipping costs are to be paid by the customer.
RETENTION OF TITLE
Any delivered goods shall remain the property of Schneggenstein until payment has been made in full.
RIGHT OF WITHDRAWAL
Schneggenstein reserves the right to withdraw from the contract in cases of default of payment or default of acceptance. Schneggenstein shall be discharged from any further contractual obligations in cases of default of payment. Entitlements for services still to be rendered or for pre-payments can be claimed from Schneggenstein.
Should there be an unjustified withdrawal on behalf of the customer, Schneggenstein may choose to either demand fulfillment of the contract or agree to termination of the contract.
In case there should be any misunderstanding between the English translation and the German description on the website then the German version shall be deemed as the only binding version.
Place of performance and jurisdiction for both parts shall be the Commercial Court of Vienna, Austria. Only Austrian law shall be applicable.
